This Bitfinex review works from the public record rather than the marketing. Bitfinex is an offshore exchange run by iFinex Inc. (British Virgin Islands). It does not serve US persons, has restricted UK individuals since late 2023, and as of October 2026 has no MiCA authorisation in the EU. It shares senior management and a long history with Tether. Below are court and regulator records on the 2016 theft of 119,754 BTC, the 2021 settlements, and the restitution now flowing back to the exchange. After that come the zero-fee model introduced in December 2025 and how margin funding works.
Key takeaways
- US persons are excluded. New York trading was barred under the 2021 Attorney General settlement. UK individuals who opened accounts from 1 November 2023 cannot verify.
- In August 2016 a hacker transferred 119,754 BTC out of Bitfinex. Ilya Lichtenstein was sentenced to five years in November 2024, and a court ordered 94,643 recovered BTC returned to Bitfinex in kind.
- Bitfinex and Tether paid $18.5 million to the New York Attorney General (February 2021). Separately, the CFTC fined Bitfinex $1.5 million and Tether $41 million (October 2021).
- Since 17 December 2025, Bitfinex has charged no maker or taker fees on spot, margin, perpetuals, securities pairs and OTC trading. Lenders in margin funding still pay 15% of the interest they earn (18% on hidden offers).
- No deposit insurance or compensation scheme covers customer assets. This review is not legal or financial advice.
Bitfinex review: who can legally use it, and who is excluded
| Jurisdiction or group | Status as of October 2026 | Basis |

| United Kingdom | On the FCA warning list (October 2023). UK residents who registered from 1 November 2023 cannot verify as individuals. Existing non-exempt UK corporates were limited to reducing positions and withdrawing from 10 January 2024. | FCA warning list; Bitfinex UK customer notices |
| European Union | Not listed on ESMA’s register of MiCA-authorised crypto-asset service providers. The MiCA transitional period ended on 1 July 2026. | ESMA interim MiCA register. Check the current entry yourself. |
| El Salvador | Licensed. Bitfinex Securities (April 2023) and Bitfinex Derivatives El Salvador S.A. de C.V. (relocated from Seychelles in January 2025) hold Digital Asset Service Provider licences. | CNAD (National Commission of Digital Assets) notices |
| Bitfinex Securities products | Also off-limits to Canadian and Spanish persons and to residents of Austria and Italy, among others | Bitfinex Securities prohibited-jurisdictions page |
| Sanctioned or embargoed regions | Excluded, for example Iran, North Korea, Cuba, Syria and occupied regions of Ukraine | Bitfinex terms |
Third-party summaries also say Bitfinex withdrew from Ontario in 2022. Confirm this and your own country’s status in the current terms at bitfinex.com before opening an account. Type the address yourself and do not trust “Bitfinex support” accounts that contact you first. Do not use a VPN or false residence details to get around these restrictions. That breaches the terms, can lead to frozen funds, and in sanctioned regions can be illegal.
The 2016 hack, the arrests and the recovered bitcoin
The theft. On 2 August 2016, according to the US Department of Justice, Ilya Lichtenstein used more than 2,000 fraudulent transactions to move 119,754 BTC from Bitfinex to wallets he controlled. At the time this was worth about $70 million. Bitfinex did not absorb the loss alone. It applied a roughly 36% “generalised loss” across customer balances and issued BFX debt tokens. These were later redeemed or converted into iFinex shares, and a smaller group received Recovery Right Tokens (RRT) entitling them to a share of any recovered coins.
The prosecutions. Lichtenstein and his wife, Heather Morgan, were arrested in February 2022 after investigators traced the laundering. Both pleaded guilty in 2023. In November 2024, Lichtenstein was sentenced to five years and Morgan to 18 months. The DOJ said more than 96% of the stolen bitcoin was recovered, helped by Lichtenstein’s cooperation.
The restitution fight. In January 2025 a federal court in Washington, D.C. accepted that 94,643 BTC, plus forked coins (BCH, BSV, BTG), should be returned to Bitfinex as in-kind restitution under the plea agreements. Notably, the court found that Bitfinex and its users did not meet the legal definition of “victims” under the Mandatory Victims Restitution Act. Judge Colleen Kollar-Kotelly also questioned whether restitution would improperly reduce the forfeiture order. Government transfers to Coinbase described as part of the restitution process followed in 2026, including about 264.9 BTC on 6 October 2026.
What Bitfinex says it will do. The exchange has said it will first redeem the outstanding RRTs. After costs, it will use at least 80% of the remaining net proceeds to buy back and burn UNUS SED LEO, the exchange token it issued in 2019. That is a company commitment, not a guarantee, and it says nothing about LEO’s future price.
The governance lesson cuts both ways. The 2016 hot-wallet design failed badly. Even so, Bitfinex kept operating, and the recovery mechanism it created in 2016 is now paying out after a decade.
Regulator settlements and the Tether connection
Bitfinex and Tether are sister companies. They share parent-level history under iFinex. Paolo Ardoino is Tether’s chief executive and, according to 2026 conference listings, still Bitfinex’s chief technology officer. Our guide to Tether covers USDT itself. These are the parts of the record that concern the exchange:
- June 2016, CFTC. Bitfinex was ordered to pay $75,000 over financed retail commodity transactions with US persons.
- 2018–2019, NYAG investigation. New York’s Attorney General alleged that, after a payment processor holding about $850 million of Bitfinex funds ran into trouble, Tether’s reserves were used to cover the shortfall without disclosure. The office also said USDT was not fully backed by dollars in a bank account for part of 2017.
- February 2021, NYAG settlement. Bitfinex and Tether agreed to pay $18.5 million, stop trading activity with New Yorkers and file reserve reports for two years, without admitting wrongdoing.
- October 2021, CFTC. Bitfinex paid $1.5 million for illegal off-exchange retail commodity transactions with US residents, operating as an unregistered futures commission merchant and breaching the 2016 order. Tether paid $41 million over misleading statements about USDT’s backing.
The common thread is control: the same small group runs both the largest stablecoin issuer and the exchange where much USDT trades. Problems at one can quickly affect the other. That concentration is the main structural risk to weigh, beyond any single feature.
Bitfinex fees and margin funding explained
| Item | Snapshot (Bitfinex help centre, October 2026) |
|---|---|
| Spot and margin trading (maker or taker) | 0% since 17 December 2025 |
| Perpetual derivatives | 0% maker and taker |
| Securities pairs and OTC | 0% |
| Margin funding (lender side) | 15% of interest earned, or 18% for hidden offers |
| Withdrawals and some fiat services | Charged, and they vary by asset and network. See the fee schedule. |
Bitfinex has called zero trading fees a permanent change, saying revenue comes from lending, withdrawal and other service fees. Spreads and order-book depth still affect what you pay.
How margin funding works. Margin funding is a peer-to-peer lending market. Lenders offer coins or stablecoins at a daily rate for 2 to 120 days, and margin traders on Bitfinex borrow them to take leveraged positions. Interest is calculated to the second. The lender receives 85% of it in the standard case. Rates float with demand, so there is no fixed or expected return. The risks are that funds can sit idle when demand is low, that lent assets remain on a custodial offshore exchange, and that the platform’s liquidation engine has to close losing positions before lenders are affected. On the borrowing side, leverage can wipe out a position quickly. Our explainer on crypto margin trading covers liquidation mechanics.
Account security options on Bitfinex
Bitfinex’s help centre describes several account controls. These include two-factor authentication with an authenticator app or a hardware security key (U2F), withdrawal address whitelisting, IP-address restrictions and granular API key permissions. Turn on hardware-key 2FA and address whitelisting before depositing anything meaningful. Because Bitfinex sits outside the reach of most national regulators and offers no compensation scheme, these controls, plus withdrawing funds you are not actively trading, are your main protection.
On reserves, check whether Bitfinex currently publishes wallet addresses or a proof-of-reserves report. Remember that any reserve snapshot shows assets but not liabilities, and says nothing about the iFinex–Tether intercompany relationships described above.
How Bitfinex compares with larger exchanges
- Versus regulated venues (for example MiCA-authorised or US state-licensed exchanges): Bitfinex offers zero trading fees, deep BTC/USD and USDT books, and margin funding. It lacks local regulatory protection and, for many readers, legal access.
- Versus other offshore derivatives exchanges: it has a longer operating history and a documented recovery from its 2016 hack, but the closest ties of any major exchange to a single stablecoin issuer. Our list of crypto derivatives exchanges sets out alternatives, and our safest crypto exchange criteria explain how to weigh licences, reserves and incident history.

FAQ
Can US customers use Bitfinex?
No. Bitfinex’s terms exclude US persons, and the CFTC fined it in 2016 and 2021 over transactions with US residents. Its 2021 settlement with the New York Attorney General also required it to stop trading activity with New Yorkers. US residents should use exchanges licensed in their state.
Is Bitfinex a scam?
The record does not support calling it a scam. It has operated since 2012, paid out recovery tokens after the 2016 hack, and is receiving restitution under a US court order. It has, however, settled with US regulators over undisclosed losses and misleading statements, and it operates offshore without broad licensing. Weigh those facts, not the label.
Did Bitfinex users get their hacked bitcoin back?
Partly, and over time. In 2016 Bitfinex spread the loss across accounts and issued BFX tokens, later redeemed, and Recovery Right Tokens. A January 2025 ruling returns 94,643 BTC to Bitfinex in kind. Bitfinex says it will redeem outstanding RRTs first and use at least 80% of the remaining net proceeds to buy back and burn LEO.
Does Bitfinex charge trading fees?
Not on most trading. As of October 2026, Bitfinex’s help centre says no maker or taker fees apply to crypto spot and margin pairs, perpetual derivatives, securities pairs and OTC trading from 17 December 2025. Withdrawal fees still apply, and margin-funding lenders pay 15% of interest earned.
